PMK 44/2026: Retired MoF Officials Must Observe a 5-Year Cooling-Off Period Before Acting as Tax Representatives

Minister of Finance Regulation No. 44 of 2026 (PMK 44/2026) introduces several key revisions regarding tax representation. Notably, the regulation imposes a five-year cooling-off period on former Ministry of Finance (MoF) personnel seeking to act as tax representatives under the “Other Parties” category.

This policy applies across the board to retired Civil Servants (ASN), personnel who resigned or separated prior to retirement age, and former Contract-Based Government Employees (PPPK) within the Ministry of Finance.

Why the Cooling-Off Period?

The mandatory hiatus is part of the government’s broader strategy to safeguard integrity, professionalism, and independence in tax administration. By instituting a deliberate gap before former MoF officials can practice as tax representatives, the government aims to mitigate potential conflicts of interest and bolster public trust in the tax administration system.

Eligibility Criteria for Retired MoF Civil Servants

PMK 44/2026 permits retired MoF civil servants to register as tax representatives, provided they satisfy specific criteria. Beyond demonstrating standard tax competence under applicable regulations, retirees must possess an unblemished record from their tenure in public service.

Specifically, candidates must have no prior history of severe disciplinary sanctions, particularly those involving abuse of authority, bribery, illegal fees, conflicts of interest, or other serious misconduct.

Furthermore, former personnel may only begin practicing upon the completion of a full five-year cooling-off period, calculated from the official date of retirement stated in their retirement decree.

Applicability to Early Separations and Resignations

The cooling-off rule is not limited to age-mandated retirees. MoF civil servants who leave service prior to retirement age may also serve as tax representatives, provided they were honorably discharged, meet competency requirements, and maintained a clean disciplinary record throughout their tenure.

In these instances, the five-year waiting period is calculated from the effective date of separation stated in the honorable discharge decree.

Regulations Governing Former Contract Employees (PPPK)

PMK 44/2026 extends similar provisions to former MoF contract personnel (PPPK). Ex-PPPK personnel are eligible to become tax representatives if they demonstrate required competencies and possess a clean service record.

Additionally, they must not have been dishonorably discharged or subjected to severe disciplinary sanctions under their employment agreements.

Like civil servants, former PPPK personnel must observe the five-year cooling-off period, measured from the end of their employment contract or the effective date of their honorable discharge.

General Requirements for “Other Parties” Still Apply

Beyond these background-specific prerequisites, former MoF personnel must fulfill all general requirements applicable to “Other Parties” as outlined in PMK 44/2026.

This includes obtaining a Certificate of Registration (Surat Keterangan Terdaftar or SKT) as proof of eligibility to act as a tax representative. The SKT serves as the official reference for the Directorate General of Taxes (DGT) to record and manage individuals authorized to act on behalf of taxpayers.

Authorized Categories for Tax Representation

Under PMK 44/2026, taxpayers may authorize a representative through a Special Power of Attorney (Surat Kuasa Khusus or SKK). Authorized representatives fall into three categories:

  • Certified tax consultants;
  • Qualified “Other Parties” who meet regulatory requirements; and
  • Designated family members in accordance with applicable rules.

While an authorized representative may manage procedural tax matters, legal liability for fulfilling tax rights and obligations remains entirely with the taxpayer as the authorizing party.

Conclusion

PMK 44/2026 opens the door for retired MoF civil servants, former employees, and ex-PPPK personnel to work as tax representatives. However, this path is conditional on stringent requirements, including a clean track record and the completion of a five-year cooling-off period.

This regulatory measure underscores the government’s commitment to strengthening governance among tax practitioners while maintaining integrity and objectivity within Indonesia’s tax system.
